ROTTNEST EXPRESS - TERMS AND CONDITIONS

These Booking Conditions set out the terms on which you contract with us for your Journey. By making a Booking, you acknowledge that you have read, understood and agree to be bound by these Booking Conditions. We reserve the right to change these Booking Conditions at any time prior to you making a Booking. Capitalised terms are defined at the rear of these Booking Conditions.

1. BOOKINGS

A Booking is confirmed (and a contract between you and us comes into effect) when: You have made a Booking and have provided us with all necessary information to process your request; payment has been received in full; and we have issued you with a Booking Confirmation.

2. PRICES

All Prices are in Australian dollars and include GST where applicable. We reserve the right to change Prices at any time prior to Booking confirmation. The Rottnest Island Admission Fee is set by the Rottnest Island Authority and is subject to change without notice.

3. PAYMENT

Full payment is required at the time of Booking. Payment surcharges may apply for credit and debit card transactions and will be shown at checkout.

4. CANCELLATIONS AND CHANGES BY YOU

Cancellations made more than 24 hours before departure may receive a Credit Note. Cancellations within 24 hours of departure are non-refundable. Changes to bookings may incur administration fees.

5. CANCELLATIONS BY US

We reserve the right to cancel or alter Journeys due to Force Majeure, safety concerns, or insufficient bookings. We will provide a full refund or Credit Note in such circumstances.

6. BIKES AND BAGGAGE

Each bike travelling on the ferry requires its own bike freight ticket. Bikes must comply with size and weight restrictions (max 1.3m x 45cm x 22kg for standard bikes). E-bikes must have removable batteries. Child trailers must be emptied and folded. We reserve the right to refuse carriage of bikes that do not meet our requirements.

7. CONDUCT

Passengers must follow all instructions from our staff and the Master. We reserve the right to refuse travel to any passenger whose behaviour poses a risk to safety or the comfort of other passengers. No refund will be given in these circumstances.

8. FORCE MAJEURE

We will not be liable for any failure to perform our obligations under these Booking Conditions where such failure is due to Force Majeure. Force Majeure includes natural disasters, adverse weather, war, civil strife, terrorist activity, epidemic, pandemic, or any government restriction.

9. HEALTH AND MOBILITY

You are responsible for ensuring you are fit to travel. You must advise us at the time of Booking of any medical conditions, disabilities or mobility issues that may affect your Journey or require special assistance.

10. ANIMALS

No animals are permitted on our vessels except certified guide dogs and hearing dogs accompanying passengers with disabilities.

11. RESPONSIBILITY

Journey Services supplied by us: To the extent only that we are the principal supplier to you of Journey Services which we directly control, operate or own then we will provide those Journey Services with reasonable skill and care. We will only be responsible for our employees in the course of their employment, and for our agents and contractors where we have direct control over them. We will not be responsible for any loss, damage, claim or expense caused by the acts or omissions of yourself, of any other third party not connected with the provision of the Journey Services, or due to an event of Force Majeure.

Services supplied by Independent Suppliers: Where an Independent Supplier is the supplier of Journey Services, you acknowledge that our obligations to you are limited to taking reasonable care to select a reputable Independent Supplier. To the fullest extent permitted by law, we will not be responsible to you for any loss, damage, personal injury or delay attributable to the actions, omissions or negligence of an Independent Supplier.

Recreational Services: If we supply any Recreational Services to you, then to the maximum extent permitted by law we exclude any liability for death, physical injury or mental injury resulting from our failure to comply with a guarantee that applies under Australian Consumer Law. You acknowledge that you engage in any recreational activity at your own risk.

General liability limitation: We cannot guarantee our schedule. We will not be responsible for any loss or additional expenses you incur for any missed connections or services attributable to delays. To the fullest extent permitted by law, our maximum liability to you under these Booking Conditions is limited to arranging for the Journey Services to be resupplied or payment of the Price.

12. COMPLAINTS

In the event of a problem with any aspect of your Journey Services you must tell us or make our representative aware as soon as possible. If you notify us of a problem during travel and we have not resolved it to your satisfaction, please follow this up in writing within 30 days from the end of your Journey.

13. REFUNDS

Any refunds payable by us will be made as follows: if you paid by credit or debit card, we will credit the same card; if you paid by direct bank transfer, we will pay the refund to a bank account notified by you; if you booked through a travel agent, we will pay the refund to the travel agent.

14. DEEMED ACCEPTANCE

If you place a booking on behalf of another party, you represent and promise us that you are duly authorised to provide the agreement and consent of the other party to be bound by these Booking Conditions.

15. IMAGE RELEASE

We and our suppliers may take photographs or make recordings of you and your activities during the Journey for promotional and marketing purposes. You consent to this use and acknowledge you will not be entitled to any payment or compensation. If you do not consent, please advise us at least 21 days prior to your Journey.

16. GENERAL

The contract between us and you is governed by the laws of the State of Western Australia. Any disputes shall be dealt with by a court with the appropriate jurisdiction in Western Australia. Any personal information you provide to us will be collected and used in accordance with Australian Privacy Principles and our Privacy Policy at https://rottnestexpress.com.au/privacy-policy/

These Booking Conditions are effective and apply to all Bookings made from 1 June 2025.
